Repossession

You will have seen the statement “Your home is at risk if you fail to make the repayments on your mortgage” Failing to make mortgage repayments could result in the mortgage lender obtaining a court order to repossess the property.

Specialist solicitors have expert knowledge on how to avoid lenders taking repossession action and preventing the case going to court. Should a case go to court, the court will not necessarily find in the lender's favour. Repossession orders are often set aside in favour of structured repayment proposals that the court agrees are feasible.

If you are falling into arrears with your mortgage repayments then you should take advice from a specialist solicitor even if you think you are able to catch up. Likewise, if you receive a letter from your mortgage lender chasing arrears, you should seek advice immediately.

Lenders can easily apply for a court summons, which you will need to respond to. Your solicitor will advise on the chances of the repossession order being successful and their proposal to prevent this happening.

Having listened to all the evidence compromises might include repayment plans for arrears, or giving you time to sell the property yourself.
